TIMERTAG DOWNLOAD AND USAGE AGREEMENT

Please review and confirm the following terms before downloading your template. By checking the box and downloading the asset, you agree to be bound by this Agreement on behalf of yourself or the organization you represent.

1. Trademark & Usage License

Timertag is a trademark of Senver Holdings Pty Ltd, used under license by Senver Group Pty Ltd (ABN 90 622 761 380). This template contains official Timertag branding and logos protected by trademark law. You are granted a non-exclusive, revocable license to print and use these labels solely in connection with authorized Timertag products and services. You may not alter, misrepresent, or commercially resell these branding assets.

 

2. Clinical Responsibility Acknowledgment

Timertag Go is a formatting and digital delivery utility. It is not a medical device, nor does it provide medical advice, clinical oversight, diagnostic tracking, or direct patient care management.

• Duty of Care: The healthcare professional, clinic, or the organization deploying these printed templates retains sole and absolute clinical responsibility for how the labels are utilized, how staff or patients interact with them, and all resulting clinical outcomes.

• User Risk Assessment: You acknowledge that you have conducted your own independent clinical risk assessment regarding the suitability of these visual aids for your specific operational, healthcare, or medical environment

Senver Group Pty Ltd disclaims all liability for any medical errors, adverse health events, patient misunderstandings, treatment delays, or injury associated with the deployment, physical placement, or reliance upon these labels.

 

3. Connectivity, Geo-blocking & System Availability

The practical utility of a physical label depends entirely on the end-user’s ability to access its digital destination. Senver Group Pty Ltd cannot guarantee:

• That the end-user (e.g., patient or staff member) will have active internet connectivity or a compatible mobile device to scan the tag.

• That the online services will be fully accessible in all regions, as local telecommunications failures, regional internet disruptions, or international geo-blocking may restrict digital access.

• Continuous, uninterrupted uptime of the landing destination. You are solely responsible for ensuring appropriate clinical redundancies and analog backups are in place if a user is unable to scan the tag.

 

4. Third-Party Print & Alignment Tolerance

This PDF template is formatted strictly to a 20x40mm specification. Because third-party commercial printers (such as Sticker Mule and Avery WePrint) utilize varying cutting tolerances, bleed requirements, and machine drift, Senver Group Pty Ltd does not guarantee perfect physical alignment, layout margins, or color matching. You are entirely responsible for reviewing and approving the final physical proof with your chosen print vendor.

 

5. Limitation of Liability & Consumer Guarantees

• Statutory Carve Out: Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable statute that cannot be excluded, restricted, or modified by agreement.

• Limitation: To the maximum extent permitted by law, and subject to the statutory provisions above, Senver Group Pty Ltd shall not be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, third-party printing costs, clinical liabilities, regulatory issues, or business interruptions) arising from the use or inability to use this template or its underlying services.

 

6. Indemnity

To the maximum extent permitted by law, the deploying organization agrees to indemnify, defend, and hold harmless Senver Group Pty Ltd, its directors, officers, and employees, from and against any third-party claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising out of or resulting from the organization’s deployment, physical placement, or clinical use of the printed templates.

 

7. Governing Law & Jurisdiction

This Agreement, your use of the template, and any disputes arising out of or in connection with the underlying services shall be governed exclusively by, and construed in accordance with, the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales and any courts competent to hear appeals from those courts.

8. General Provisions

• Severability: If any provision of this Agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Agreement, which will continue in full force and effect.

• Entire Agreement: This Agreement constitutes the entire understanding between you and Senver Group Pty Ltd regarding the Timertag Go template download, superseding all prior oral or written representations.

• Amendments: Senver Group Pty Ltd reserves the right to amend these terms at any time by updating the version posted on this site. Continued deployment of templates after an amendment constitutes acceptance of the revised terms.
